Terms of service

These terms of service govern the use of the Cutlingo service at cutlingo.com. The service is operated by MEVARO GROUP s.r.o., Veľká okružná 17, 010 01 Žilina, Company ID (IČO) 57 408 343, Tax ID (DIČ) 2122708401, registered in: Obchodný register Okresného súdu Žilina, oddiel Sro, vložka č. 89841/L (hereinafter “we” or “the operator”). 1. What Cutlingo is

Cutlingo is a web application that creates a transcript of the speech in an uploaded video, splits it into blocks and, from the blocks you choose, makes short vertical clips with captions (hereinafter “the service”). We provide the service as a digital service remotely over the internet.

The transcript, speaker recognition and captions are created by an automated system. They may contain errors, especially with names, technical terms, noisy audio or several speakers talking at once. Please check each clip before you publish it. You can correct both the transcript and the captions in the application.

2. Account

You need an account to use the service. When registering, you provide a truthful email address and confirm that you are older than 16 or have the consent of your legal guardian. Keep your password safe; you are responsible for activity in your account. If you discover misuse of your account, write to us.

You can close your account at any time by emailing [email protected]. When you close your account, we delete your projects and clips; data we are required to keep by law (for example, invoices) is kept for the period set by law.

3. Plans and prices

Prices are final. The operator is not a VAT payer, so we do not add VAT to the price.

The Trial is free and one-time: one project with a video of up to 10 minutes. Clips made in the trial carry a Cutlingo watermark.

Minutes are counted by the length of the uploaded video, not by the length of the clips. You can make any number of clips from one uploaded video. Unused minutes do not carry over to the next month. With a yearly subscription, you receive the plan's minutes every month, not for the whole year at once.

4. Subscription and payment

You can subscribe to paid plans monthly or yearly. The yearly subscription is discounted: you pay for 10 months and get 12. You pay in advance by payment card through the Stripe payment gateway; we do not see or store your card details. The subscription renews automatically at the end of each period (month or year) and the amount is charged to your card until you cancel it. We will send you an invoice by email.

For a yearly subscription, we will send you a reminder by email at least 14 days before it renews, with the renewal date and the amount.

You can cancel your subscription at any time, by emailing [email protected] or in the application if we make that possible there. Cancellation takes effect at the end of the period already paid for, and until then you can keep using the service. We do not refund money for a period that has already started, except in the cases under Articles 5 and 8.

We may change prices. We will notify you of a new price by email at least 30 days in advance, and it will only apply from the following period. If you do not agree with it, cancel your subscription.

5. Withdrawal from the contract (for consumers)

If you are a consumer, you can withdraw from the subscription contract without giving a reason within 14 days of its conclusion. Just send an unambiguous statement by email to [email protected] or use the model form.

When ordering a paid plan, you expressly request that we start providing the service immediately, before the withdrawal period expires. If you then withdraw, we will refund the amount paid minus a proportionate part for the service provided up to the withdrawal; we calculate the proportionate part from the video minutes you processed in that period relative to the plan's minutes. We will refund the money within 14 days of receiving the withdrawal, using the same method you used to pay.

If you used up all of the plan's minutes within the withdrawal period, the service has been provided in full for that period and the right of withdrawal expires; we will inform you of this when you order.

6. Your content

Videos, transcripts and clips belong to you. By uploading a video, you grant us a non-exclusive, free-of-charge authorization to store and process the video to the extent necessary to provide the service (transcription, clip production, previews). We do not use your content for advertising, we do not sell it and we do not use it to train artificial intelligence models.

You may only upload video to which you hold the necessary rights and, where required, for whose processing you have the consent of the people appearing in it. It is prohibited to upload content that breaks the law or infringes the rights of others, in particular:

• content infringing copyright or other intellectual property rights,
• content depicting child sexual abuse, or promoting violence, terrorism or hatred,
• content that interferes with the privacy or honour of other persons.

If we learn of illegal content, we may delete it and block the account. You can report illegal content to us at [email protected].

7. Retention and deletion

We automatically delete a project (the uploaded video, transcript and finished clips) 30 days after the last activity in it, i.e. after it was last opened or edited. So download your finished clips. You can also delete a project or clip yourself at any time.

8. Availability and liability

We try to keep the service running continuously, but we cannot fully rule out outages due to maintenance, technical faults or outages of our suppliers. If the service is down for a longer time through our fault, get in touch; we will appropriately extend your subscription for the period of the outage or refund a proportionate part of the price.

We are not responsible for the content you upload or for how you publish the clips. If you use the service as a business, our liability for damage is limited to the amount you paid us over the last 12 months. Towards consumers, we are liable to the extent provided by law.

9. Complaints

If the service does not work as it should (for example, a clip is not made or is corrupted), write to us at [email protected]. State your account email, the project or clip, and a description of the problem. We will confirm receipt of the complaint by email. We will handle the complaint without undue delay, no later than 30 days after it was filed. If it is justified, we will fix the defect, make the clip again without deducting minutes, or appropriately reduce the price.

We do not consider inaccuracies in the automatic transcript, which you can correct in the application, to be a defect.

10. Dispute resolution

If you are not satisfied with how we handled your complaint, or you believe we have violated your rights, you can ask us for redress at [email protected]. If we reject your request or do not respond to it within 30 days, as a consumer you are entitled to file a proposal for alternative dispute resolution with an alternative consumer dispute resolution body, in particular Slovenská obchodná inšpekcia (Slovak Trade Inspection) (soi.sk). A list of other bodies is kept by Ministerstvo hospodárstva SR (Ministry of Economy of the Slovak Republic).

Compliance with obligations towards consumers is supervised by Slovenská obchodná inšpekcia (Slovak Trade Inspection), Inšpektorát SOI pre Žilinský kraj (SOI Inspectorate for the Žilina Region), Predmestská 71, 011 79 Žilina.

11. Changes to the terms

We may change these terms, for example when the service or legislation changes. We will notify you of a change by email at least 14 days before it takes effect. If you do not agree with the change, you can cancel your subscription and close your account.

12. Final provisions

The contractual relationship is governed by the law of the Slovak Republic. This does not deprive a consumer of the protection afforded by the mandatory provisions of the law of the country of their residence. The processing of personal data is described in the Privacy Policy.
